THE PROMOTION AND PROTECTION FREEDOM OF RELIGION IN INDONESIA

Freedom of religion right is classified in the category of basic human rights, its absolute is a manifested of inner freedom. This right is categorized as non-derogable right which mean that right cannot be deferred fulfillment by the state on every situation, but in the implementation there are still many problems. Due to the existing problems, the researcher aimed to investigate the implementation freedom of religion and beliefs in Indonesia according to legal regulation. This research used normative legal research with case approach. Types and sources of data used are secondary data. The data are sourced from legislation, books, literature, documents, and archives relating to the problems studied. Data collection methods used are library research and literary studies. qualitative methods was used as the data analysis techniques. The results showed that there are three problems that arise from freedom of religion in Indonesia. First, structure of law that in this case are state, government, and the state apparatus, those are Police, Prosecutor, and Judge. Second, legal substance that are still contradictory among regulation. Third, the legal cultur. It is because no matter how legal products and government established well, but the culture of the community is not run well established, then freedom of religion can be implemented perfectly.
