PELAKSANAAN PEMBAGIAN HARTA WARISAN UNTUK AHLI WARIS ANAK (STUDI PUTUSAN NOMOR 67/PDT.G/2019/PA.YK JO PUTUSAN NOMOR 2/PDT.G/2020/PTA.YK)

The problem of dividing inheritance according to Islamic law can be done if thetestator has died. According to KHI, an heir is someone who is related by bloodand marriage to the heir. The biological children, both male and female, are theheirs of their parents. However, in reality, there are still heirs who feel that theinheritance that their parents have entrusted to them means it has become theirs, even though it is also the right of the other heirs because the inheritance has not been distributed. This research is a type of normative research using literaturestudies and interviews with notaries as resource persons. The analysis used inthisresearch is descriptive qualitative. The conclusion of this research is that thepanel of judges granted the claim of the plaintiffs because they had fulfilledcertain conditions according to the Islamic Inheritance Law and the Qur'an SurahAn-Nisa' verse 7 which explains that sons and daughters have their respectiveinheritance shares. each ordained by Allah.
