Abstract

ABSTRACT
Constitutional Court Decision No. 33/PUU-XIII/2015 states that Article 7 point r of the Regional Head Election Law is contradictory to the 19545 Constitution, particularly on prohibition of discriminative action as stated in Article 27 verse (1), Article 28D verse (1) and (3) and Article 28J verse (1) and (2) of the 1945 Constitution. Therefore, political dynasty is constitutionally accepted in the 1945 Constitution. This research aims to analyze the impact of political dynasty in local democracy. The research is a normative legal research with descriptive qualitative method. The facts show that the impact of political dynasty in case of Ratu Atut Chosiyah and the case of Sri Hartini, the political dynasty lead to abuse of power. Otherwise, the political dynasty of Syahrul Yasin Limpo shows that political dynasty leads to bring the region to a better prosperity.The research recommends, firstly, in order to control the practice of political dynasty there needs to be an enhancing of political education. Political education for regional heads is vital in order to lead them to understand the ethics of a good governance and also increase political education for the society. Therefore, people can choose intelligently and honestly and also can give contribution as parties to the checks and balances of power. Secondly, law enforcement is one of the most important things in achieving good governance because political stability and security can only be uphold if the rule of law runs properly. Therefore, law enforcement is needed in the practice of political dynasty to prevent th abuse of power.
