Abstract

This undergraduate thesis attempts to elaborate the interest of Japan as a rational actor in rejecting the ratification of Basel Ban Amendment when it tries to enter the force. Japan is known as one of the largest industrialized country with its several important elements of industrial products to be consumed worldwide. From that industrial process of production, Japan instantly becomes the generator of massive industrial toxic and hazardous waste. When the problem of toxic and hazardous waste run seriously, Basel Convention has been formed as the international agreement which is formally handle the transoundary movement of toxic wastes. In the years after, the Basel Ban Amendment defined to more enforce and prohibits the export of industrial toxic and hazardous waste to developing countries. Unfortunately, the enthusiasm from toxic waste generators includes Japan is being contradicted to the ban. Japan is more choosing to implement the domestic environmental law in disciplining the movement of toxic waste and binding the bilateral trade agreement with countries to reduce the risk of waste at home. Japan also rationally considers that the export of toxic waste to be disposed in developing countries will be more economic. In fact, although become the REVWDFOH IRU %DVHO %DQ $PHQGPHQW¶V UDWLILFDWLRQ� EXW -DSDQ KDV DOUHDG\ UHDFKHG LWV QDWLRQDO LQWHUHVW WR VDYH WKH HQYLURQPHQW DQG FRQWLQXLQJ WKH QDWLRQ¶V HFRQRPic well being without signing the ban.
