Abstract
Mediation is one of alternative dispute resolution with simple process, short time, and low cost. This article aims to analyze the resolution of land disputes through mediation in the land office of Bantul Regency. The method used in this legal research is an empirical research. The research was conducted by examining the problems that exist directly through field research to obtain primary data, and to complete and compare these data, a library research was conducted to obtain secondary data. The result of the study show that resolving land dispute through mediation at the Land Office of Bantul Regency was handled by Section of Problems Handling and Land Control referrings to the Regulation of The Agrarian Minister And Spatial/ Head of The National Land Agency Number 11 of 2016 about settlement of land case. However, in principle, mediation at the Land Office of Bantul Regency can leave the procedure according to the rules that apply as along as both sides agree on the results of the mediation. By leaving the prevailing rules, the parties are free, flexibe, and not be caught up in forms of formalism. In addition, mediation conducted at the Land Office of Bantul Regency uses a persuasive approach by promoting the principle of justice. This is evident from the parties callings separately to know the will of the parties and obtaining information from both sides. The inhibitory factor in the settlement of land disputes through mediation are: the lack of participation from the parties, the different desire from the parties, the parties remain on its founding, the shortage of human resources in the land office of Bantul Regency, the lack of data needed in the settlement of disputes, and the limited funds that are estimated to settle the land disputes.
