Abstract
At this time, the relationship between Financial Services Institutions and Consumers/Customers is not only a contractual relationship. However, the relationship that is built between financial service institutions and consumers is also based on the element of trust. These 2 (two) financial services business are used as the basis for dispute resolution in the financial services sector. However, the settlement is divided into 6 (six) sectors: Banking, Insurance, Capital Market, Guarantee, Pension Fund, and Financing and Pawnshops. Therefore, at the end of 2020, OJK again issued POJK No. 61/POJK.07/2020 concerning Alternative Institutions for Settlement of Financial Services Sector Disputes. The existence of the latest Financial Services Authority Regulation makes the dispute resolution process initially divided into 6 (six) financial services sectors. This time, it is centred on 1 (one) alternative dispute resolution institution for the financial services sector. The purpose of this study is to identify and analyze the application of the unification principle. And integration in dispute resolution through alternative dispute resolution institutions in the financial services sector, authorities and dispute resolution mechanisms. The research method used is normative legal research. This study uses data and primary legal materials in legislation and secondary legal materials taken from books and articles/journals. This study indicates that the principles of unification and integration have been applied in the dispute resolution process in the financial services sector through alternative dispute resolution institutions in the financial services sector. In the dispute resolution process, this institution has the authority divided into 2 (two), namely the primary/principal authority and additional authority. The dispute resolution mechanism in this institution has also been regulated. Although there is no specific chart/structure, it is listed in the Alternative Dispute Resolution Institution Regulations and is divided into three stages.
