Abstract
This thesis is written to attempt to describe the United States' policy of Freedom of Navigation which was carried out as a form of America's response to the unilateral claim to ownership of the South China Sea by the People's Republic of China. The United States has stated in the US maritime policy of 1983, the United States will exercise and enforce, the right to freedom of use of the seas throughout the world in a manner consistent with balancing their interests in accordance with the conventions of the law of the sea. In the official document of the US Department of Defense, it is emphasized that the United States opposes coastal states that make excessive claims that are not in accordance with the conventions of the law of the sea, and America will not approve of unilateral actions by other countries that aim to limit the rights and freedoms of the international community over the sea area. This Freedom of Navigation was carried out for the first time in the South China Sea area during the leadership of President Barack Obama through military operations by sailing US warships in the disputed area, namely the South China Sea, precisely in the area where China is conducting reclamation in the Subi Reef area. The Freedom of Navigation policy certainly doesn't stop with Barack Obama's leadership, because the FON Policy is still being carried out by the president-elect after Obama, namely Trump and Biden.
