Abstract
In recent times, not a few imported used clothing have been freely circulatinginthesociety, be it through offline sales somewhere or online through social media. Regulationsregarding imported used clothes have been regulated by the government in several statutoryprovisions, i.e., Law No. 7 of 2014 on Trade and Regulation of the Minister of Trade of theRepublic of Indonesia no. 51/M-DAG/PER/7/2015 on Prohibition of Importing Used Clothing. However, in reality, many imported used clothing continue to circulate throughout Yogyakarta. This study aims to discover why many imported used clothing are still circulating in Yogyakarta, as well as to examine whether the sale and purchase of imported used clothing in Yogyakartaisprohibited or not, using empirical normative research and primary, secondary, and tertiarylegal materials. This research analysis uses a statutory approach. Many imported used clothes arestill circulating in Yogyakarta because of the ignorance of the imported used clothing traders about the prohibition against importing used clothing, the lack of government or competent authoritysupervision, and the large market demand for imported used clothing, as well as the public's lackof legal awareness. The sale and purchase of imported used clothing in Yogyakarta is prohibitedbecause it does not meet the objective standards for the legitimacy of an agreement.
