Abstract

Cross-border money laundering has become an international problem that requires international solutions. Globalization has given rise to this crime and facilitated the perpetrators fled to foreign jurisdictions to avoid prosecution. This reality can lead to impunity and injustice. Therefore, APSC as a forum or arena and as an independent actor is time for law enforcement against perpetrators of this crime to be reconstructed through Mutual Legal Assistance as an alternative to extradition following the enactment of the ASEAN Treaty on Mutual Legal Assistance 2004 in Criminal Matters 2004. This research is doctrinal and strengthened by field research which turned out to show that the implementation of the 2004 MLAT was heavily influenced by politics
