Abstract

The crime of trafficking in persons is the most serious violation of human dignity and arguably a modern form of human slavery. On that basis, human trafficking has become a special concern of various countries, including the Indonesian government. In the trafficking network, people cannot be separated from national borders which are very easy to cross by unscrupulous persons. They already have a cross-country network that is structured very neatly and is very secret in its existence. Trafficking in persons is one of the worst forms of treatment from a violation of human dignity and a modern form of human slavery (Modern Slavery). This normative legal research uses a statute approach, a comparative approach, a case approach and a conceptual approach. The data used in this study is secondary data in which there are legal materials which can then be qualified into primary legal materials and secondary legal materials. From the results of this study and the discussion, the following conclusions are drawn: Trafficking in persons is a criminal offense according to Indonesia and Malaysia. In Indonesia, the crime of trafficking in persons is regulated in Law Number 21 of 2007 concerning Eradication of the Crime of Trafficking in Persons, while Malaysia is regulated in Deed 670 of 2007 concerning Anti Trafficking in Persons and Anti Migrant Smuggling. Regarding this legislation, there are both similarities and differences. Law enforcement in cases of trafficking in persons by conducting covert or public operations to identify cases, follow up directions and monitor perpetrators. All formal rules for identifying trafficking cases are used. In conducting investigations, law enforcement officers need to be careful, because the modus operandi of traffickers is getting more sophisticated. Improvements that need to be made regarding criminal acts of trafficking in persons in the future are the need for joint arrangements that can be a solution for the perpetrators involved, both the perpetrators who send and those who receive all must be subject to sanctions. The goal is to provide legal justice and legal certainty for the victims.
