TINJAUAN YURIDIS TERHADAP PERTIMBANGAN HAKIM TENTANG PENGANGKATAN ANAK (STUDI KASUS PENETAPAN PENGANGKATAN ANAK DI PENGADILAN AGAMA BANTUL)

Adoption of a child must be done through a court decision. The goal is to have legal certainty in the future for adopted children and adoptive parents. This study aims to determine the rights obtained by adopted children as stipulated in the determination of adoption. This research uses normative legal research by using secondary data from primary, secondary and tertiary legal materials. Researchers conducted interviews with resource persons, namely the Head of the Bantul Religious Court. The research material obtained was analyzed descriptively and qualitatively. The conclusion is that the Bantul Religious Court granted the application for adoption with Stipulation No. 0129/Pdt.P/2014/PA.Btl, Stipulation No. 128/Pdt.P/2021/PA.Btl, and Stipulation No. 337/Pdt.P/2021 /PA.Btl. In the court's decision, it is determined that the child has rights in the form of maintenance for daily life, education and teaching costs, and health and other care costs are the obligations of the adoptive parents. This is as stipulated in Article 171 letter (h) of the Compilation of Islamic Law.
