Abstract
In today's modern era, technology and the internet have developed rapidly to create impacts on finance and buying and selling transactions. The merger of financial innovation (financial technology peer-to-peer lending) with a place for buying and selling transactions (marketplace) is known as paylater. Shopee is a platform that provides various products and payment methods using a paylater named SPayLater. The aims of the study are to identify the application of SPayLater payment feature and to analyze Shopee marketplace payment feature: SPayLater seen from the Islamic law perspective. This study used descriptive qualitative research method, namely the research methods based on the philosophy of postpositivism are used to examine the condition of natural objects in which put the researcher as a key instrument. The study results are first, SPayLater payment feature can be activated if users have met the terms and conditions in SPayLater, then followed by the SPayLater activation procedure. After being approved by Shopee, users can use SPayLater as a payment method. Second, the Shopee marketplace payment feature, namely SPayLater contains handling fees, interest, and late fees which are not in line with the issues represented in the pillars and wakālah (appoints an agent to do investment activities) requirements in DSN-MUI Fatwa No. 10/DSN-MUI/IV/2000 about wakālah contracts. According to Islamic law, the practice of SPayLater is considered as usury which is categorized as usury nasī'ah.
