PENEGAKAN HUKUM DALAM PERAPAN DIVERSI TERHADAP TINDAK PIDANA PENCURIAN OLEH ANAK DI BAWAH UMUR DI TINGKAT PENYIDIKAN

This study aims to determine the application and implementation of diversions carried out by the Sragen District Police in handling criminal acts of theft committed by minors. The research method with a descriptive empirical juridical approach. Data sources consist of primary data, namely the results of interviews and secondary data from the literature. Data collection method with interviews and literature study. Then the data were analyzed with qualitative data analysis methods. Diversion control efforts carried out by minors because of criminal acts of theft is an application by Sragen District Police to help facilitate handling criminal cases committed by children, if the crime committed is a crime of theft without repetition and detained under 7 (seven years. By following Law No. 11 of 2012 concerning the Criminal Justice System of the Child and get assistance from various parties and even from the community as seen from Law No. 11 of 2012 concerning the Criminal Justice System of Children in Article 1 paragraph (3). In the application of this diversion there are factors that influence the implementation of diversion which is the legal factor, law enforcement factors, supporting facilities or facilities, community factors and cultural factors.
