THE URGENCY OF GIVING AUTHORITIES IN MAKING DIRECTIVE PRINCIPLE OF STATE POLICY TO PEOPLE CONSULTATIVE ASSEMBLY

The Amendment of 1945 Constitution has changed the position of the People Consultative Assembly (MPR) in the constitutional system, where previously the MPR was the highest state institution to become only a high state institution. One of the powers of the MPR that cannot be applied is the authority to make the Directive Principle of State Policy (GBHN). Therefore, Indonesia forms a new guideline to be applied in the reform era namely the National LongTerm Development Plan (RPJPN). But in its application, RPJPN has not been effective as a substitute for the GBHN as a state guideline. Through normative legal research, this undergraduate thesis analyzes the prospect of re-enacting the GBHN by giving the authorities to the MPR in reformation era through several ways that could be through the amendment of 1945 Constitution or the Constitutional Convention. This research concludes that the MPR can be given the authority to re-enact the GBHN in the Reformation Era.
