LEGAL PROTECTION FOR CHILDREN DUE TO THE FAILURE OF MARRIAGE (DIVORCE) IN THE CASE OF EARLY MARRIAGE IN CILAWU SUB-DISTRICT

Establishing a lawful relationship with the marriage bond is a sacred thing in Islam. Marriage in Indonesia is regulated in Law No. 1 of 1974 which includes an age limit of 19 years. However, the problems that occur in Cilawu Sub-District are many cases of early marriage, which are then unavoidable from divorce. This happens because the quality of the partner who is not qualified makes divorce as a way to resolve disputes. Finally, the responsibility of the divorced child returns to the parents and must be protected by the State. In connection with this writing, it is intended that the State can pay more serious attention to cases of early marriage and protect the rights of women and their children during marriage, even though the responsibility of the divorced child is fully returned to their respective parents. This research was written using the normative-empirical legal research methodology where the primary source was obtained by analysis of the act, the compilation of Islamic law, journals, several books, related legal sources, and analysis of events that occurred in society, then supported by a second source of law which obtained by interview. The fact that happened is that in 2015-2018 there were 91 cases of early marriage taken from 3 villages in Cilawu Sub-District. It is recorded in the Religious Courts (PA) that divorce cases in Garut District have increased every year as many as 3,525 lawsuit cases have been handled from early 2021 to December 2021. Thus, the role and function of the government must be felt by all levels of society even though they are in remote areas, so that cases of early marriage and divorce problems can be resolved and understood by all Indonesian citizens and regions without any exceptions. Thus, the role of parents in family life is very influential in the creation of the quality of human beings.
