Abstract
The research aimed at figuring out the work program on BPJS health
insurance in Indonesia and the views based on Muhammadiyah Muslim scholars.
The research belongs to qualitative research by employing methods such as
observation, note taking, and observing the subjects under study. The interview
data were directly obtained from the perceptions of the Muhammadiyah Muslim
scholars in the Special Region of Yogyakarta. Several sources were from the
Majlis Tarjih Muhammadiyah book. The research findings revealed that the
Muhammadiyah Muslim scholars argue that there is no clear fatwa regarding the
BPJS, there needs to be some improvements in the contract so that no one feels
disadvantages, so that the participants understand clearly what the BPJS
regulations are. Muhammadiyah Muslim scholars also argue that the contract
clearly does not have elements of ghahar, maysir, and followed by sincerity and
willingness to take part in the BPJS. There needs to be transparency regarding the
funds collection so that there is no misunderstanding between the company and
the participants. The Muhammadiyah Muslim scholars advise that BPJS should
provide services in sharia manner for health insurance, so that it was
conceptualized from the beginning. If the contract was not clear from the
beginning, it is clear whether it is a ta’awun or tabarru’ just for the sake of
helping others.
