Abstract

<p>At the end of 2019 people in Wuhan contacted a foreign pneumonia disease which identified by the World Health Organization (WHO) as COVID-19. China as the state of origin of the plague took inappropriate measures which constitutes human rights violations on the right to life and the right to the highest attainable standard of health under the Universal Declaration of Human Rights (UDHR) and the International Covenant on Rights, Economics, Social, and Cultural (ICESCR). In addition, it includes violations of freedom of expression, assembly, and information because China also covers up the initial stages of virus development and refuses to inform the WHO quickly and transparently in accordance with the International Health Regulations (IHR) 2005. Thus, international community claims China violates its obligations under international law and is required to be held state responsibility under Responsibility of States for Internationally Wrongful Acts (ILC Draft) 2001. The research is normative legal research by using a juridical approach related to state responsibility of international spread of plague under international law by examining theories, concepts, legal principles, and laws related to the issue. The research shows that China has committed breach of international obligations and attributable to bear state responsibility under International Law.</p>
