PENERAPAN DIVERSI TERHADAP PELAKU TINDAK PIDANA ANAK OLEH POLRES BANTUL

Law Number 11 of 2012 concerning the Juvenile Criminal Justice System has become a
bulwark as a protection for children in conflict with the law. The law on the juvenile criminal
justice system contains a process for resolving child cases through non-litigation channels, namely
by diversion. Where this diversion has the aim of achieving peace between victims and children,
resolving child cases outside the court, preventing children from deprivation of independence,
encouraging the community to participate, and instilling a sense of responsibility in children.
Diversion is applied to children who are 12 years old but not 18 years old or 12 years old even
though they have been married but are not yet 18 years old, threatened with imprisonment for
under 7 years and are not a repetition of a crime The problems that the researchers took in this
study were about the procedure and the application of diversion at the investigation stage and
knowing the rights of children who were in the process of diversion in the jurisdiction of Bantul
Regency.
