PENEGAKAN HUKUM PIDANA TERHADAP PELAKU PEREDARAN ROKOK ILRGAL DI KABUPATEN JEPARA

The distribution of illegal cigarettes is widely found in Indonesia, especially
in Jepara Regency. Illegal cigrettes are in demand because they are cheaper,
especially if they are compared to legal cigarettes whose just increased the
excise tax. Illegal cigarettes worsen Indonesian public health and also have
the potential to harm the country. The formulation of the problems in this
research is what’s the cause of the perperators distributing illegal cigarettes
in Jepara Regency and how is the criminal law enforcement against the
perperators who distributing illegal cigarettes in Jepara Regency that has
implemented so far. The method of this research is uses empirical normative
methods and uses qualitative analysis methods. The conclusions from this
research is that the cause of the perperators distributing illegal cigarettes is
to get profits and because distributing illegal cigarettes is a family bussiness
that already run from their parents. Criminal law enforcement that has
implemented are preventive law enforcement (prevention) and represive law
enforcement (active). Criminal law enforcemet that has implemented
against the perperators of illegal cigarettes distribution in Jepara regency
has been quite effective, it can be seen by the decrease in data investigation
and in criminal cases of illegal cigarettes distribution in Jepara on 2018-
2020, although it has decreased, the criminal law enforcement must be
improved again so that the case of illegal cigarettes distribution in Jepara
Regency is completely gone.
