Abstract

The negotiation process has been remaining the deadlock stage among both parties in the case of Mindanao conflict. The implementation of Tripoli Agreement 2001-2010 that was signed in Libya has not solved the Mindanao conflict that happens for a long time. The refusing from elites Philippines under Arroyo administration toward responding the case of Ancestral Domain that aimed to separated from Philippines constitution are strictly made that negotiation impossible to be implemented. In other hand, there is a kind of tendency from conflicting parties within protracted conflict in Mindanao so that, it was made the failure of negotiation process between GPH and MILF in 2001 until 2010. In this undergraduate, the writer is trying to analyses several factors which are influences the failures of negotiation process between GPH and MILF by using Jaya Deva Uyangoda perspective. The perspective of Uyangoda are explains about the difficulties of negotiation process in Separatism conflict which is tend to be failed in matching their agreements. It was influenced by four factors that are first, any kinds of maximalist of insurgent among both parties in negotiation process. Second factors, there is inflexibility of state in responding separatism conflict. Third factors, there is kinds of fear of settlement between both parties and the last factors is the uncertainties of negotiation outcomes after implemented negotiation. The writer is analyses several evident that happens when the negotiation process has been conducted which is reflected the four factors on Uyangoda perspective. This undergraduate thesis was used qualitative method which is trying to collect the data from several sources such as internet, formal website, books, and several journals that concerned toward Mindanao study. Besides of that, the data are founded as well from the researcher who has specialization or capable in this case. In this undergraduate thesis, the writer also attached the negotiation process of GPH and MILF in period of 2001-2010 and also draft of both parties in conducting negotiation process.
