Abstract
Based on data from UNHCR (2021) the number of child refugees in Indonesia was 3,655 or around 27% of the total refugees in Indonesia (13,497). 126 of them were child refugees who came alone or separated from their families. Even though Indonesia has not ratified the 1951 Convention Relating to the Status of Refugees (Refugee Convention), but Indonesia has ratified the Convention on the Rights of the Child (CRC) which automatically means Indonesia has the responsibility to providing protection for child refugees during their transit in Indonesia. The Study aims to examine the implementation of the protection for child refugees in Indonesia under International Law. The study using Statute Approach as a normative legal research. By using qualitative descriptive method, the research uses law as a foundation of norm and done through a library research with existing journal sources, internet, and books. The result shows that the protection for child refugees in Indonesia under international law is under the CRC. As the implementation, Indonesia has issued Law No. 22 of 2003 concerning Child Protection which was changed to Law no 35 of 2014 concerning Amendments to Law No. 22 of 2003. However, the implementation of the child refugees protection in Indonesia is still not fully implemented. The result also shows that there are several rights that are not fully fulfilled for child refugees in Indonesia especially on education rights, health rights, and the right to an adequate standard of living due to several factors such as economic, social, and the national regulation.
