Abstract

<p>Sewa menyewa adalah perjanjian dimana pihak satu mengikatkan kepada pihak lainnya untuk memberikan kenikmatan dari sesuatu barang selama waktu tertentu dan membayar suatu harga yang disanggupinya. Tanah kas Desa adalah tanah milik Negara yang diserahkan ke Desa yang dimanfaatkan untuk kepentingan masyarakat Desa. Tanah kas Desa dapat disewa oleh perorangan, badan hukum maupun badan usaha. Pemanfaatan dan pengolahan tanah kas Desa diatur oleh Pemerintah Desa. Pemerintah Desa juga sebagai pemegang kekuasaan pengelolaan aset Desa. Pemerintah Desa memiliki wewenang antara lain membuat kebijakan mengenai pengelolaan aset Desa, memilih petugas untuk mengatur aset Desa dan menetapkan penggunaan, pemindahantanganan atau pemanfaatan aset desa. Penelitian ini bertujuan untuk mengetahui legalitas dan penyelesaian wanprestasi pembayaran terhadap perjanjian sewa menyewa tanah kas Desa antara Pemerintah Desa Banguntapan dengan CV. Jati Putra. Metode penelitian ini menggunakan penelitian hukum normatif dan penelitian hukum empiris. Legalitas perjanjian sewa menyewa tanah kas Desa antara Pemerintah Desa Banguntapan dengan CV. Jati Putra, dapat Penulis simpulkan legal secara hukum karena Pemerintah Desa Banguntapan dan CV. Jati Putra dalam pembuatan perjanjian tersebut sesuai dengan wewenang masing-masing.. Penyelesaian wanprestasi pembayaran ini dilakukan dengan cara mediasi dan melalui Pengadilan Negeri Bantul.</p>

<p>A lease is an agreement in which one party binds to another party to provide enjoyment of something for a certain time and pay a price that it is willing to accept. Village treasury land is land belonging to the State that is handed over to the Village which is utilized for the benefit of the Village community. Village treasury lands can be leased by individuals, legal entities or business entities. The utilization and processing of Village treasury lands shall be regulated by the Village Government. The Village Government is also the holder of the power to manage Village assets. The Village Government has the authority to, among other things, make policies regarding the management of Village assets, elect officers to regulate Village assets and determine the use, transfer or utilization of village assets. This study aims to determine the legality and settlement of default payments on the village treasury land lease agreement between the Banguntapan Village Government and CV. Jati Putra. This research method uses normative legal research and empirical legal research. The legality of the village treasury land lease agreement between the Banguntapan Village Government and CV. Jati Putra, the author can conclude legally because the Banguntapan Village Government and CV. Jati Putra in making the agreement in accordance with their respective authority. Settlement of this payment default is done by means of mediation and through the Bantul District Court.</p>
