Abstract
The research aims to analyze the power and limit of the state in the state of emergency and whether Indonesia has properly adopted the concept of powers and limits of the state during COVID-19 pandemic. The method of the research is normative legal research using statute and case approach. The result shows that the state applied some types of power in an emergency. However, in using their powers, the government must consider the limits. The Indonesian government does not properly adopt the concept of power and limit in the state of emergency on COVID19. The government may take actions to respond to the pandemic. Nevertheless, there was a tendency to exceed the state of emergency limits. The action of Indonesian government was not inaccordance with the state of emergency principles during COVID-19 Pandemic. The research recommends the government and the House of Representatives in the future should obey the state of emergency principles, particularly in terms of state power limits. In addition, individuals, groups of people, or organizations should be allowed to submit a judicial review of the policy articles that violate the state of emergency principles in handling pandemics.
